US v. Blackstone Medical, Inc., No. 10-1505
In a qui tam action brought under the False Claims Act (FCA) and involving a claim that the defendant fraudulently billed Medicaid and Medical in violation of 31 U.S.C. sections 3729(a)(1) and (2), Rule 12(b)(6) dismissal by the district court is reversed where plaintiff's complaint sufficiently pled a materially false or fraudulent claim within the meaning of the FCA. Read more...
