In a dispute involving the retroactive application of Family Code section 1612 to invalidate a premarital agreement regarding spousal support, judgment of the trial court is affirmed in part and reversed in part where the court erred in concluding that the 2002 amendment to section 1612 applied to a premarital agreement executed before the amendment's enactment, but properly found that the spouse against whom enforcement was sought voluntarily entered into that agreement and that the premarital agreement was not unconscionable Read more...
