Government Contracts United States Federal Circuit, 04/07/2011 Energy Northwest v. US, No. 2010-5112 In an appeal arising from a breach of contract by the government for the disposal of spent nuclear fuel, award of damages by trial court is partially affirmed where: 1) plaintiff failed to show causation for costs associated with site modifications; 2) award of damages to offset indirect overhead mitigation costs were proper; and 3) award of interest on costs was improper since government did not waive its sovereign immunity against such recovery.
