Landsman and Funk PC v. Skinder-Strauss Assoc., No. 09-3105
In a class action dispute involving whether the Telephone Consumer Protection Act (TCPA), 47 U.S.C. section 227(b), confers federal, diversity jurisdiction for private causes of actions, judgment of district court dismissing action for lack of subject matter jurisdiction is reversed where on the language, structure, and legislative history of the statute, Congress did not divest the federal courts of diversity jurisdiction over private causes of action under the TCPA.
